Terms of Service: Safe Return (Rescue Mission System)

IMPORTANT: BY ACCESSING OR USING THE SAFE RETURN SYSTEM ("SERVICE"), YOU AGREE TO BE BOUND BY THESE TERMS. THIS SERVICE IS A TOOL FOR ASSISTANCE AND DOES NOT REPLACE PROFESSIONAL CAREGIVING OR emergency SERVICES.
1. CRITICAL SAFETY WARNINGS & DISCLAIMERS
1.1 "Assistive Tool" Only - NO GUARANTEE OF SAFETY
Safe Return is strictly an aid for caregivers. It is NOT a replacement for physical supervision, locks, fences, or professional medical care.
- We do NOT guarantee the prevention of wandering, injury, or death.
- We do NOT guarantee that a patient will be found within any specific timeframe (including the "15-Minute" target).
- We do NOT guarantee 100% uptime. Services rely on third-party GPS, Cellular Networks (5G/LTE), and Cloud Providers (Mapbox, Render), which are subject to failure.
1.2 Limitation of Technology
You acknowledge that the Service has inherent limitations:
- GPS Drift: Location data helps but may be inaccurate by 10-50 meters due to urban canyons or weather.
- Battery: The device battery may die unexpectedly. While the system boosts urgency and maximizes telemetry when battery is critically low, it cannot function after shutdown.
- Connectivity: "Dead zones" exist where no cellular signal is available. In these zones, the Service CANNOT function.
- WiFi Fence: Departure detection via WiFi depends on the home network being operational. Router outages, power failures, or network changes may trigger false departures or miss real ones.
- Wrist Detection: Off-body sensors vary by device and may not detect removal in all circumstances (e.g., if the watch is placed on a warm surface). Wrist detection is a supplementary signal, not a guarantee.
1.3 Not a Medical Device
Medical bio-data (Heart Rate, Fall Detection) is for informational purposes only. The Service is not an FDA-approved medical device and should not be used for diagnosis or treatment. Always call 911 immediately in a true medical emergency.
1.4 Guest Mode & Drill Mode Disclaimers
Guest Mode (Testing Without Account):
- Purpose: Guest Mode is provided solely for evaluation and testing purposes using demo data
- Demo Data Only: Guest mode uses pre-configured demo data for drill simulations. No personal data is collected or stored.
- No Emergency Services: Guest mode does NOT provide real emergency response capabilities:
- ❌ No real-time tracking of actual patients
- ❌ No SMS alerts to emergency contacts
- ❌ No 911/EMS dispatch capabilities
- ✅ Drill simulations only — for demonstration purposes
Drill Mode (Simulated Rescue Scenarios):
- Not Real Emergencies: Drill Mode simulations are NOT REAL and should NOT be relied upon in actual emergencies
- Testing Tool: Drills are designed to familiarize users with the interface and alert system
- No Guarantee: Successful completion of a drill does NOT guarantee the system will function identically in a real emergency
- System Testing: While drills test the app's UI and alert sounds, they do NOT test:
- Actual GPS accuracy in your region
- Cellular connectivity in dead zones
- Battery performance under real-world conditions
- Third-party service availability (Twilio SMS, Mapbox, etc.)
- Recommendation: Even after subscribing, perform real-world system checks (not drills) by:
- Testing actual GPS tracking with the patient's device
- Verifying SMS delivery to your emergency contacts (opt-in test mode)
- Checking battery drain rates during active tracking
BY USING GUEST MODE OR DRILL MODE, YOU ACKNOWLEDGE THAT THESE FEATURES ARE FOR DEMONSTRATION AND TESTING ONLY AND CARRY NO LIABILITY FOR SAFE RETURN IF YOU MISTAKENLY RELY ON THEM FOR ACTUAL SAFETY.
2. LIMITATION OF LIABILITY (The "Hold Harmless" Clause)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFE RETURN (AND ITS DEVELOPERS, AFFILIATES, OFFICERS, AND EMPLOYEES) SHALL NOT BE LIABLE FOR:
- ANY PHYSICAL INJURY, DEATH, OR HARM TO THE PATIENT OR CAREGIVER RESULTING FROM USE OR INABILITY TO USE THE SERVICE.
- FAILURE TO RESCUE: ANY FAILURE OF THE SYSTEM TO LOCATE A PATIENT IN TIME TO PREVENT HARM.
- FALSE ALARMS: ANY COSTS INCURRED DUE TO FALSE EMERGENCY DISPATCHES (E.G., POLICE/AMBULANCE FEES) CAUSED BY SYSTEM ERRORS OR FALSE POSITIVES.
- DATA LOSS: LOSS OF HISTORICAL TRACKING DATA OR MEDICAL RECORDS.
YOU AGREE TO INDEMNIFY AND HOLD HARMLESS SAFE RETURN FROM ANY CLAIMS, DAMAGES, OR LAWSUITS ARISING FROM A FAILURE OF THE SYSTEM TO PERFORM ITS INTENDED FUNCTION DURING A CRISIS.
3. Emergency Services Automation (DEFCON 1)
3.1 Authorization to Act
By enabling "Auto-Escalation" or "EMS Dispatch", you explicitly grant Safe Return legal agency to:
- Contact Emergency Services (911/EMS) on your behalf.
- Share the Patient's "Rescue Bio" (Name, Photo, Medical History, Location) with first responders.
- You accept full responsibility for any fines or penalties resulting from false dispatch.
4. User Responsibilities ("The Caregiver's Duty")
The System is only as good as the humans managing it. You agree to:
- Daily Charging: Ensure the Patient's device is charged daily.
- Monthly Testing: Perform system checks at least once per month:
- Drill Mode: Test the app's UI and familiarize yourself with alerts (recommended for new users)
- Real-World Test (PRO subscribers): Verify actual GPS tracking, SMS delivery, and device connectivity in your specific environment
- Correct Data: Keep the "Rescue Bio" (Photos, Medication List) up to date. We are not responsible for old photos leading to failed recognition.
- Profile Maintenance:
- Account Users: Keep your profile up to date and update emergency contacts if phone numbers change
5. Subscription & Billing
5.1 Free Features (No Payment Required)
- Guest Mode: 100% free, unlimited testing without account creation
- Drill Mode: Free simulations for both guests and account holders
- Account Creation: Free to create an account and set up profiles
- No Credit Card for Testing: Guest mode requires zero payment information
5.2 Paid Features (PRO Subscription Required)
- SaaS Model: Real-time GPS tracking and emergency response features require an active PRO subscription, billed monthly/yearly

- Payment Failure: Failure to pay will result in service suspension (tracking and alerts disabled)
- "Grace Period" for Safety: We commit to a 7-day grace period for failed payments before downgrading service, recognizing the critical safety nature of the app
- Refunds: No refunds for partial months
- Free Tier After Cancellation: If you cancel your subscription, you retain access to:
- Your account and profile data (read-only)
- Drill Mode simulations
- Profile editing (data persists but no live tracking)
6. Privacy & Data Rights
- Ownership: You own your patient's data.
- Guest Mode Data:
- Guest mode uses demo data only — no personal data is collected or stored
- When you create an account, you set up your loved one's profile from scratch in our secure database
- "Break Glass" Access: You consent that deeply private data (location history) is decrypted and exposed to Third Parties (Police/EMS) ONLY during a confirmed DEFCON 1 Emergency.

7. Governing Law
These Terms are governed by the laws of the State of Delaware (or applicable jurisdiction), without regard to conflict of law principles. Any usage of this app constitutes agreement to arbitration rather than class-action lawsuits.
